Information We Collect

Information you provide: We collect information you submit, including your name, email address, billing and shipping addresses, phone number, order details, messages to our team, and text you send to the automated Momenza Assistant.

Photos and personalized designs: When you use our customization tools, we process the photos you upload, your engraving text, and the previews, design files, and three-dimensional models created during the customization process. These materials may contain personal information about you or other people.

Payment information: Payments are processed through our checkout and payment providers. We receive order and payment-status information. Payment details are handled according to the applicable provider’s privacy practices.

Website activity: We collect information about how you interact with our website, such as your IP address, browser and device information, pages viewed, and interactions with our customization tools, cart, and checkout. Some of this information is collected through cookies, pixels, and similar technologies.

How We Use Information

We use personal information to:

• Create previews and personalized jewelry from your submitted content.
• Process payments, fulfill orders, and arrange delivery.
• Respond to questions and provide order updates, automated guidance, and customer support.
• Maintain, troubleshoot, and improve our website and customization tools.
• Understand website activity and measure advertising effectiveness.

Your Photos, Design Files, and AI-Assisted Production

Your submitted content is processed to create your preview and personalized product and to provide related support. Where necessary, this may involve our hosting, processing, and production providers.

We reserve the right to use artificial intelligence and other automated tools to assist in designing and producing your piece, including processing images, generating or refining three-dimensional models, and preparing production files. This may involve processing your submitted content through third-party technology providers.

We do not use your uploaded photos, engraving text, or resulting design files to train AI models, and we do not authorize our service providers to use that content for AI model training.

We will not publish your photos or personalized designs, or use them in advertising or other promotional materials, without your consent.

Please upload only content you are authorized to provide, including appropriate permission from other people pictured.

Automated Momenza Assistant

When you use the automated Momenza Assistant, the text you submit and a limited recent conversation history are sent to an AI service provider so the assistant can respond. The assistant accepts text only and is not intended for photos, engraving text, payment information, passwords, authentication codes, government identifiers, or other sensitive information.

The assistant is designed without a Momenza server-side transcript or persistent browser conversation storage. Messages remain visible in the open assistant while you use it. We configure model responses so they are not stored for later API retrieval. Technology providers may still process or retain limited information for security, abuse prevention, legal compliance, and service operation under their applicable terms and privacy practices.

We measure basic assistant use, such as opening the assistant, sending a message, or choosing human support. We do not include the text of your assistant conversation in those analytics events.

How We Share Information

We share information as needed with providers that help operate our business, including:

• Shopify and payment providers, to support checkout and order processing.
• Hosting and technology providers, including AI service providers, to store information, operate our customization tools, and assist in designing and producing your piece.
• Production and fulfillment partners, to manufacture, package, and deliver your order.
• Analytics and advertising partners, to understand website activity and measure or deliver advertising.
• Professional advisers and authorities, when necessary to meet legal obligations, resolve disputes, prevent fraud, or protect rights and safety.

Information may also be disclosed in connection with a merger, acquisition, or sale of business assets, subject to applicable law.

Shopify may process information for its own purposes as described in its Consumer Privacy Policy.

Cookies and Advertising

We use cookies and similar technologies to support essential website functions, remember preferences, understand how visitors use our website, and support advertising.

Advertising technologies may disclose device identifiers and browsing or purchase activity to advertising partners. Depending on applicable law, these disclosures may be considered a “sale,” “sharing,” or processing for targeted advertising.

You can unsubscribe from marketing emails using the link in those emails. We may still send messages necessary to fulfill your order or respond to you.

Security

We use reasonable safeguards designed to protect personal information. No method of internet transmission or electronic storage is completely secure.

Children’s Privacy

Our website is intended for adult customers and is not directed to children under 13. If you believe a child has provided personal information directly to us, please contact us so we can investigate and take appropriate action.

Photos of children submitted by adult customers are handled under the photo and design provisions of this policy.

International Processing

Our providers may process and store information in countries other than where you live, including the United States. Where applicable law requires protections for international transfers, we will use the required safeguards.

Changes to This Policy

This Privacy Policy is subject to change. We may update it to reflect changes in our services, technology, information practices, or legal requirements, including changes to how we use AI-assisted production tools.

We will post the updated policy here and revise the “Last updated” date. Where required by applicable law, we will provide additional notice or obtain consent before applying changes. An update to this policy does not, by itself, authorize us to use previously collected content for AI model training.

Return and Refund Policy

Custom and Personalized Products

Momenza products are made to order using the photograph, personalization details, and options selected by the customer. Because each item is personalized, we do not accept returns, exchanges, or refunds for:

• Changes of mind
• Dissatisfaction with the photograph selected by the customer
• Aesthetic preferences when the finished item conforms to the approved design and product specifications
• Minor variations in color, finish, texture, or detail that are expected from handcrafted products, natural materials, screen settings, or the manufacturing process
• Damage caused after delivery by wear, misuse, improper care, or alteration

Eligible Order Problems

Please contact us if your order arrives damaged, defective, incorrect, or materially different from the approved design or product specifications.

You must notify us within 72 hours of delivery by emailing hello@momenza.io. Include your order number, a description of the problem, and clear photographs when applicable.

Resolution and Returns

We will review the claim and, as appropriate, offer a repair, remake, replacement, or refund.

Do not return an item without authorization. If a physical return is required for an eligible claim, Momenza will provide return instructions, the return address, and a prepaid shipping label. The item must be returned by the deadline provided with those instructions. Momenza covers the return-shipping cost for an authorized eligible claim.

Refunds

Approved refunds will be issued to the original payment method within 10 business days after the claim is approved, or after the returned item is received and inspected when a return is required. Your bank or payment provider may require additional time to post the refund.

When an eligible claim receives a full refund, the refund will include the original shipping charge, including any rush-shipping charge.

Order Cancellations

Because production is personalized, orders cannot be canceled once placed.

If Momenza cancels an order because we cannot fulfill it, we will issue a full refund to the original payment method.

Gift Cards

Gift cards are non-refundable except where required by applicable law.

Nothing in this policy limits any rights or remedies available under applicable law.

In these Terms, “Momenza,” “we,” “us,” and “our” refer to Brookpont Creative LLC doing business as Momenza Studio. By using momenza.io or placing an order, you agree to these Terms & Conditions.

Custom Orders

Every piece is made especially for you using the photo, personalization details, and options you submit. Please review your image, engraving text, product selections, and shipping information carefully before checkout.

Because production is personalized, orders cannot be canceled once placed. If you need to request a correction, contact us immediately; we cannot guarantee changes after an order is placed.

Your Photos and Content

You confirm that you have the rights and permissions necessary for us to use the photos, text, and other content you submit to create your personalized piece, including appropriate permission from other people pictured.

You retain any ownership rights you hold in your submitted content. By submitting it, you give Momenza and the providers assisting us permission to process, store, reproduce, and adapt that content as necessary to create previews, design and produce your piece, fulfill your order, and provide related support, consistent with our Privacy Policy.

We may decline content that is unlawful, infringes another person’s rights, or is otherwise inappropriate. If we decline an order after payment and cannot fulfill it, we will issue a full refund to the original payment method.

AI-Assisted Design and Production

We reserve the right to use artificial intelligence and other automated tools to assist in designing and producing your piece. This may include processing images, generating or refining three-dimensional models, and preparing production files, including through third-party technology providers.

We do not use your uploaded photos, engraving text, or resulting design files to train AI models, and we do not authorize our service providers to use that content for AI model training.

Permission to Publish

We will not publish your photos or personalized designs, or use them in advertising or other promotional materials, without your separate consent. Placing an order does not grant that consent.

Previews and Finished Pieces

Digital previews illustrate how your personalized piece may look. Translating a photograph into a physical relief involves interpretation, and some details may be simplified or adjusted for production.

The finished piece may vary from the on-screen preview in appearance, detail, color, and finish due to the selected material, manufacturing process, lighting, and screen settings. These variations do not affect your rights if a product is defective or materially different from its description.

Production and Shipping

Each piece is custom made to order. Production and delivery estimates are provided in good faith but are not guaranteed delivery dates unless we expressly state otherwise.

Shipping costs and available delivery options are calculated and displayed at checkout. Customers are responsible for shipping charges unless a promotion expressly states otherwise. We currently ship only to eligible addresses within the United States and do not offer international shipping.

Rush shipping may be available at checkout. Rush shipping applies only to carrier transit after production is complete and does not shorten the made-to-order production period.

If we cannot ship within the stated timeframe, we will notify you and provide a revised estimate. Where required by applicable law, we will offer cancellation and a refund or obtain your agreement to a delay.

We will send tracking information once your order ships.

Order Questions and Problems

If your piece arrives damaged, defective, incorrect, or materially different from the approved design or product specifications, contact hello@momenza.io within 72 hours of delivery with your order number and, where applicable, clear photos of the issue.

Returns & Exchanges

Because each piece is personalized, we do not accept returns or exchanges for changes of mind, dissatisfaction with a customer-selected photo, or expected handmade variations. For an eligible order problem, we will review the claim and, as appropriate, offer a repair, remake, replacement, or refund. If an approved physical return is required, Momenza will provide a prepaid shipping label and return instructions. Nothing in these terms limits any cancellation, refund, replacement, or other consumer rights available under applicable law.

Privacy

Our Privacy Policy explains how we collect, use, retain, and share personal information, including uploaded photos and generated design files. Please review it for details about our practices and your privacy choices.

Changes to These Terms

We may update these terms from time to time and will post the revised version with an updated date. Updated terms apply to use of the website and orders placed after they take effect. Unless otherwise agreed or required by law, an existing order remains subject to the terms in effect when it was placed.

Changes to these terms do not, by themselves, authorize publication of your content or its use for AI model training.
